Do I need a permit to build a fence and how high can my fence be?

A permit is not required to build a fence. However, the following requirements must be met:

    • On a parcel within R zones and R3 zones, no fence shall exceed a height of 1.3 metres (4.3 feet) in a front setback and corner side setback, and 2.0 metres (6.6 ft) in a side setback or rear setback.
    • No fence shall exceed a height of 2.0 metres (6.6 feet), except on a parcel in the RU, C4, I and A zones, unless the fence is required by the Zoning Bylaw for screening.
    • On a parcel within I zones and the C4 zone no fence shall exceed 2.5 metres (8.2 feet) in height.

Do I need a permit to build a landscape retaining wall?

A permit is required for a landscape retaining wall that is more than 1.5 metres (4.9 feet) tall.

Construction of a retaining wall from 1.5 metres (4.9 feet) to 2.5 metres (8.2 feet) requires a building permit and professionally engineered designs. Retaining walls shall not be closer than 2.0 metres (6.6 feet) apart.

The maximum height of a fence located on top of a retaining wall is 1.3 metres (4.3 feet).

The construction of a retaining wall that is higher than 2.5 metres (8.2 feet) is not permitted without a Development Variance Permit. Setbacks are not required from the property line.

Retaining walls under 1.5 metres (4.9 feet) do not require a permit, however; site location should be confirmed with the Building Inspection Department staff.

Note: A retaining wall that is attached to a building and is greater than 1.2 metres (3.9 feet) requires a  permit and professionally engineered design.
